Trust is important, especially when it comes to data. For this reason, we consider it as our duty to gather only those data which are strictly necessary, to manage the data with due care and to protect it against misuse.

3. Collection and storage of personal data as well as nature and purpose and their use
IWS Ltd. processes your personal data in compliance with the EU General Data Protection Regulation (GDPR), the provisions of the applicable insurance contract laws that are relevant to data protection law, Liechtenstein due diligence legislation and all other relevant laws.

By concluding the insurance brokerage agreement, you instruct IWS Ltd. to advise and intermediate insurance contracts under private insurance law and to represent you in all insurance matters vis-à-vis insurers.

If you submit an application for the conclusion of an insurance contract, the insurers need the information provided by you for assessing the risk, concluding the contract and fulfilling legal obligations.

If the insurance contract is concluded, IWS Ltd. processes this data for the execution of the contractual relationship (e.g. for your support and perception of your interests, notification obligations to authorities, fulfillment of regulatory requirements).

The conclusion or execution of the insurance brokerage contract or the insurance contract is not possible without the processing of your personal data.

IWS Ltd. collects the following data:
  • Title, first name, surname, gender, marital status, date of birth, nationality
  • Address, email-address, telephone number
  • Occupation, employer
  • Bank data
  • Tax number
  • Health data (if required by insurance contract law)
  • Information on the income and assets situation and the origin of the assets
The collection of these data takes place:
to identify you as our customer;
to conclude an insurance brokerage contract and as a consequence of an insurance contract;
for correspondence with you;
to exercise the obligations arising from the insurance brokerage contract and relevant legislation

Your data will be processed on the basis of Art. 6 para. 1 letter b GDPR. Insofar as special categories of personal data for data processing (e.g. health data when an insurance contract is concluded) are required, the processing of your data will be based on Art. 6 para. 1 letter a GDPR and IWS Ltd. obtains your consent in accordance with Art. 9 para. 2 letter a combined with Art. 7 GDPR.

IWS Ltd. also processes your data for the legitimate interests of IWS Ltd. or third parties (Art. 6 para. 1 letter f GDPR). This may be necessary in particular:
  • to ensure IT security and IT operations,
  • for the prevention and investigation of criminal offenses, in particular we use data analysis
  • to detect indications that may indicate insurance fraud,
  • Consultation and exchange of data with information points,
  • Enforcement of legal claims and representation in litigation,
  • Coorporate Governance, Risk Management
In addition, IWS Ltd. processes your personal data for the fulfillment of legal obligations on the basis of Art. 6 para. 1 letter c GDPR (e.g. regulatory requirements, commercial and fiscal retention requirements, provisions of the due diligence legislation or statutory provisions, in particular advisory, documentation and information requirements).

4. Recipients or categories of recipients of personal data
Your personal data will be transmitted to:
  • Insurers
  • Authorities / courts to fulfill legal obligations
  • (processor / external service providers): IWS Ltd. partly uses contract processors / external service providers to fulfill contractual and legal obligations. A listing can be found on our homepage http://www.iws.li via the link “data protection declaration”.
5. Transfer of personal data to a third country
Should IWS Ltd. transfer of personal data to service providers outside the European Economic Area (EEA), the transfer takes place only if the the EU Commission has confirmed that this country fulfills an adequate level of data protection or other appropriate data protection guarantees (e.g. binding corporate data protection rules or EU standard contract clauses). 6. Duration of storage of personal data
Your data will be collected by IWS Ltd. after the survey stored as long as this is in compliance with the statutory retention periods under Personal and Company Law (PGR), Due Diligence Act (SPG), Tax Act (StG) (The retention periods are up to 10 years) for the respective task performance (documentation, information and advisory obligations ) is required. Also, personal data will be kept for the purposes of securing evidence for the time in which claims against IWS Ltd. could be exercised (statutory limitation period of three or up to thirty years).

7. Automated decision-making or profiling
IWS Ltd. is in charge of establishing and implementing the contractual relationship with you basically none, based solely on automated processing Decision (Art. 22 GDPR). If such decisions are made in individual cases, IWS Ltd. informs. – if there is a corresponding obligation – about it in a separate procedure. On the other hand, you can object in certain circumstances.

For certain purposes, such as due diligence legislation, your data will be processed automatically.

8. Rights of persons
Under the EU General Data Protection Regulation, you have the following rights:
  • To obtain information on the processing purposes, the categories of personal data, the categories of recipients to whom your data was or will be disclosed, the planned retention period, the existence of a right of rectification, erasure, restriction of processing or opposition, the existence of a Complaint right, the source of your data, unless provided by IWS Ltd. the existence of automated decision-making, including profiling and, where relevant, meaningful information on their details,
  • To request the notification, completion or deletion of your personal data that is incorrect or not processed in accordance with the law,
  • By IWS Ltd. to require the processing of your personal data to be restricted,
  • In certain circumstances, to object to the processing of your personal data or to revoke the prior consent for processing,
  • Your personal data that you IWS Ltd. have been provided in a structured, common and machine-readable format, or to require transmission to another controller,
  • Know and identify the identity of third parties to whom your personal information is transmitted,
  • File a complaint with the competent data protection supervisory authority
9. Withdrawal with consent
If you have consentent in processing by IWS Ltd. you can revoke this consent at any time for the future. The legality of the data processing carried out on the basis of the consent until the revocation is not affected by this.

10. Right of objection in case of applicability of Art. 6 para 1 letter f GDPR
If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 letter f GDPR, you have the right to file an objection against the processing of your personal data in accordance with Art. 21 GDPR, provided that there are grounds for doing so, arising from your particular situation.

11. Right of appeal

12. Data exchange with your former insurance broker / insurer
In order to be able to check your information when concluding the insurance brokerage contract or the insurance contract or your details when the insured event occurs, an exchange of personal data with the former insurance broker / insurer named by you in the application can be carried out to the extent required.

13. Dealing with personal data on the internet
IWS. Ltd. indicates that the following information does not apply to linked facilities. If you visit the website of IWS Ltd. in the generally accessible area, IWS Ltd. needs no data from you. IWS Ltd. will only record the name of your internet service provider, the website you are coming from, and the websites you visit at IWS Ltd. visit. Anonymized data
Each time a file is requested from the download offer, access data is stored. These are non-personal data.
